Tree is not hierarchical when readonly and shared

All,
    I downloaded the latest nightly of OF and found that the tree isn't hierarchical when and instance is readonly and shared. I'm guessing these is due to a change in the tree model from yesterday? I've attached a modified version of the tree sample from the xforms sandbox that shows this problem.
